STATEMENT OF ACAP CEO MARGARET A. MURRAY
ON EFFORTS TO TAKE TEXAS vs. UNITED STATES DIRECTLY TO SUPREME COURT

WASHINGTON—ACAP Chief Executive Officer Margaret A. Murray today issued the following statement in response to the petition of the U.S. House of Representatives and several state attorneys general to the Supreme Court for a writ of certiorari in the matter of Texas v. United States:

“The Fifth Circuit’s decision to leave it to a lower court to sort out the consequences of their ruling in Texas v. U.S. would hang a veil of uncertainty over the entirety of the U.S. health care system for years – and leave the prospect of resolution tied up in the courts.

American families don’t have the luxury of that kind of timeThe uncertainty swirling around the ACA has already spread across the health care system, stifling investment and innovation and placing a damper on competition in the individual market

“Many health plans, including some of our own, have considered entering the individual health insurance market but have declined to do so in the present because of the substantial uncertainty around the MarketplacesConsumers are paying the price for this uncertainty, and it’s wholly unnecessary. The sooner we can resolve the situation, the better.

We support the House and state attorneys general in their efforts to bring clarity to our health care system and go straight to the Supreme Court in this matter. A quick resolution can illuminate the course of action that Congress and this Administration – or the next one – need take.
