Statement of ACAP CEO Margaret A. Murray on Medicare Advantage and Part D Advance Notice for Coverage Year 2027

WASHINGTON—Margaret A. Murray, CEO of the Association for Community Affiliated Plans (ACAP), released the following statement in the wake of the Centers for Medicare & Medicaid Services (CMS) releasing the proposed Advance Notice for Medicare Advantage and Part D for coverage year 2027:

“ACAP and its Safety Net Health Plan members support efforts to improve the accuracy of the Medicare Advantage risk model. We are ready to work with CMS and others to identify improvements to the model, and have proposed a few improvements of our own.

“The model as envisioned here, which forecasts an effective cut of more than three percent, is likely to jeopardize the sustainability of the D-SNP offering for many of our members. ACAP-member Safety Net Health Plans that operate a D-SNP already run, on average, a 96.2 percent medical loss ratio. We have serious concerns about what that will mean for beneficiaries.

“That said, we are encouraged by CMS’ proposal to exclude diagnoses which arise from from unlinked chart reviews which aren’t linked to a specific clinical visit. The usage of codes arising from these unlinked chart reviews raises questions about whether patients are receiving treatment for these diagnoses, and undermines the more widespread practice of chart reviews in general.

“We will continue to review the Advance Notice and assess its impact on our Safety Net Health Plan D-SNP members. But on first blush, we have reason for significant concern.

“ACAP will provide a full set of comments, and looks forward to continuing a productive dialogue with CMS.”
