ACAP Responds to OMB’s Request for Information on Deregulation in Marketplace
On May 12, ACAP submitted its comments to Russell Vought, Director of the Office of Management and Budget (OMB), in response to OMB’s Request for Information on deregulation.
The letter shares support for reasonable regulations that guarantee health care quality, security, and safety for patients and that ensure a fair business environment for health plans serving Medicaid, Medicare, and the Marketplaces, including a level playing field for nonprofit Safety Net Health Plans.
The letter also offers recommendations to reduce or revise regulations that are unnecessarily burdensome or misaligned with their intended purpose, including:
- Eliminating burdensome federal requirements such as 1095 tax form reporting, secret shopper surveys, and appointment wait time standards.
- Ending the monthly Special Enrollment Period for consumers under 150% FPL, due to concerns over abuse and unauthorized plan switching.
- Allowing greater state flexibility on network adequacy and defrayal of state-mandated benefits to better reflect local market conditions.
