ACAP Comments on Medicaid and Marketplace Proposals in House Reconciliation Legislation

On May 13, ACAP submitted its comments to the House Energy & Commerce Committee in response to Title IV, Subtitle D, Parts 1 (Medicaid) and 2 (Affordable Care Act) of the reconciliation bill released on May 11, ahead of the May 13 markup.

The comment letter notes the following:

Medicaid

  • ACAP supports provisions to streamline address verification using Medicaid managed care organizations and supports access to employment support services, provided eligibility isn’t tied to non-health activities.
  • ACAP opposes biannual eligibility checks, FMAP reductions for certain populations, erosion of provider taxes and state-directed payments, mandatory work requirements, and mandated minimum cost-sharing for Medicaid expansion enrollees.

Marketplaces

  • ACAP urges Congress to extend the enhanced premium tax credits beyond 2025 and treat them consistently with other expiring tax provisions under a current policy baseline.
  • ACAP calls for the removal of statutory barriers that block eligible consumers from receiving APTCs and opposes codifying Marketplace Integrity and Affordability rule provisions, favoring regulatory flexibility instead.
